A life plan shattered in a single night
It all began in August 2023. Tom Félix, a once high-flying executive in France, decided to change his life. Drawn by the beauty of South-East Asia, he settled in Malaysia with the ambition of opening a restaurant on an idyllic island. That plan, which could have featured in our guide to starting a business in Malaysia, descended into horror during a police check.
Accused of drug possession and trafficking, Tom Félix was immediately placed in pre-trial detention. In Malaysia, drug trafficking is governed by the Dangerous Drugs Act 1952, a law of extreme severity that, until recently, provided for the mandatory death penalty for large quantities. While Malaysia has begun reforming capital punishment, the risk remained real and the psychological pressure immense.
In focus: Perlis prison
Tom Félix spent most of his detention in the state of Perlis, on the Thai border. Conditions there are described as spartan: overcrowding, sweltering heat, limited access to medical care and a language barrier. The experience underscores how vital it is to know your rights as an expat.
The mobilisation and the diplomatic fight
While Tom was fighting for his mental survival in his cell, his family in France moved heaven and earth. His parents were received by President Emmanuel Macron, signalling the diplomatic importance of the case. France, through its consular services in Kuala Lumpur, closely followed every hearing, a reminder of how important it is for any French citizen to sign up to the register of French nationals abroad as early as the planning stage of their move.
The recent acquittal is the result of relentless work by his lawyers, who managed to expose the flaws in the investigation and the lack of tangible evidence linking Tom to any trafficking. His innocence has finally been recognised, but the scars remain indelible.

On his return to French soil, Tom spoke of abuse and degrading treatment endured during his 909 days. His account sheds light on the dark corners of the Malaysian prison system, often overlooked by tourists and expats living in luxury condominiums in Kuala Lumpur.
